These Terms of Use ("Terms") are an agreement between LSG Digital Outdoors, the developer of the PondBase mobile application ("Company," "we," "us," or "our"), and you ("User," "you," or "your"). These Terms govern your use of the PondBase mobile application and any associated functionality or services (collectively, the "Application").
Please read these Terms carefully before using the Application. By downloading, accessing, or using the Application, you accept and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Application.
The Application is intended for users 13 years of age or older. By using the Application, you represent that you meet this requirement.
We may revise these Terms from time to time. Material changes will be effective upon notice to you, for example an in-app notification or update to this page. Continued use of the Application after such notice constitutes your acceptance of the revised Terms.
Provided you comply with these Terms, the Company grants you a personal, limited, non-exclusive, non-transferable, and revocable right to access, download, and use the Application solely for your own non-commercial purposes. The Application is licensed to you, not sold — no ownership or proprietary rights are transferred under these Terms.
PondBase does not require you to create an account — your pond data (logs, readings, photos, and notes) is stored on your own device, and can be synced and backed up through your personal iCloud account if you enable that feature. You are responsible for the security of your own device and iCloud account, and for any activity that occurs through them.
We reserve the right to modify, restrict, or discontinue any part of the Application at any time, in our sole discretion, without notice, and we will not be liable if the Application is unavailable at any time or for any period.
If PondBase offers subscriptions or in-app purchases ("Paid Features"), those purchases are billed and processed entirely through the Apple App Store using your Apple ID — we do not collect or process your payment information directly. All charges, refund requests, subscription management, and cancellations are handled through your Apple ID account settings and are subject to Apple's own terms and policies.
Where a Paid Feature includes automatic renewal, your subscription will renew automatically at the price and interval disclosed at the time of purchase unless you cancel through your Apple ID account settings at least 24 hours before the end of the current period. We may change the price or terms of Paid Features going forward; where required, we will provide notice before any change takes effect, and continued use after a price change takes effect constitutes acceptance of the new price.
Any pond logs, photos, notes, or other data you create in PondBase ("Your Content") belongs to you. We do not host, publish, or make Your Content visible to other users through the Application.
PondBase may allow you to export Your Content, for example to send via email or messaging so another PondBase user can import it. Once you export Your Content and share it outside the Application, that exchange is between you and the recipient — we have no visibility into, control over, or responsibility for how exported data is transmitted, received, or used by anyone you share it with. You're responsible for making sure you have the right to share any data you export, and for verifying the accuracy of any data you import from someone else before relying on it.

PondBase may provide general information, calculators, reminders, or guidance related to pond, water, fish, plant, or wildlife care, which may draw on data from third-party sources such as weather data. This information is for general, informational purposes only and is not a substitute for professional or veterinary advice. PondBase is not a licensed aquatic, veterinary, or environmental professional, and nothing in the Application should be treated as such.
You are solely responsible for exercising your own judgment, independently verifying any guidance before acting on it, and consulting a qualified professional before making any decision — including any decision involving chemical treatments, dosing, or other actions that could affect the health or safety of your pond, fish, plants, wildlife, or people — that could cause harm if the information is inaccurate or incomplete for your specific situation. We make no representation as to the accuracy, completeness, or reliability of any information provided in or through the Application, and we undertake no obligation to update it.
The Application may retrieve or display data from third-party sources, for example weather services. We do not control and are not responsible for the accuracy, availability, or content of any third-party data source, and your use of any such data is at your own risk.
The Application may link to third-party websites or resources. We do not endorse and are not responsible for the content, accuracy, or practices of any linked third-party resource. Accessing any linked resource is at your own risk.
The Application and its entire contents, features, and functionality — including all software, text, graphics, images, and the design, selection, and arrangement thereof — are owned by the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Application is licensed, not sold, to you.
These Terms permit you to use the Application for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the Application except as expressly permitted here. All rights not expressly granted are reserved by the Company.
If you believe content accessible through the Application infringes your copyright, contact us at support@pondbasemax.com with enough detail to identify the material and your copyrighted work, and we will investigate.
YOUR USE OF THE APPLICATION IS AT YOUR OWN RISK. THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION OBTAINED THROUGH THE APPLICATION WILL BE ACCURATE OR RELIABLE.
YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY INFORMATION PROVIDED BY THE APPLICATION AND FOR ANY DECISION YOU MAKE BASED ON IT, INCLUDING DECISIONS THAT COULD AFFECT THE HEALTH OR SAFETY OF YOUR POND, FISH, PLANTS, WILDLIFE, OR OTHERS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APPLICATION. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APPLICATION WILL NOT EXCEED THE GREATER OF (A) ONE DOLLAR, OR (B) THE AMOUNT YOU PAID US IN THE ONE MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM.
ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APPLICATION MUST BE BROUGHT WITHIN ONE YEAR AFTER THE CLAIM ACCRUES, OR IT IS PERMANENTLY BARRED.
You agree to defend, indemnify, and hold harmless the Company and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Application.
By using the Application, you acknowledge that you have read and agree to these Terms. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Application and supersede any prior agreements.
Apple Inc. is not responsible for the Application and has no obligation to provide maintenance or support for it. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Our failure to enforce any provision of these Terms is not a waiver of that provision. If any provision is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force.
Any dispute arising out of or relating to these Terms or the Application will be resolved on an individual basis. To the extent permitted by applicable law, you and the Company each waive any right to participate in a class action or representative proceeding against the other. Either party may bring an individual claim in small claims court in a court of competent jurisdiction, consistent with that court's applicable rules and monetary limits.
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules.
Your pond data is stored on your own device, and can be synced and backed up to your personal iCloud account if you enable that feature. We do not maintain a separate copy of Your Content on our own servers. While our iCloud sync/backup feature is built on Apple's iCloud infrastructure, we are not responsible for the availability, reliability, or performance of iCloud itself, which is provided and operated by Apple.
We recommend keeping iCloud sync/backup enabled if you want an additional copy of your data, and using the Application's export feature periodically for a copy you control directly.
These Terms may be assigned by the Company without restriction. The sections relating to intellectual property, warranty disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive any termination of these Terms. We are not liable for delays or failures caused by events beyond our reasonable control.
